(f) Una declaración de que la información del aviso es exacta y, BAJO PENA DE PERJURIO, de que estás autorizado a actuar en nombre del titular de los derechos.
Un aviso incompleto puede no surtir efecto legal. Si te falta algún elemento te lo vamos a indicar.
Retiramos o deshabilitamos el acceso al material de forma expedita, notificamos al anfitrión que lo publicó y le entregamos copia del aviso, y lo informamos de su derecho a presentar una contra-notificación.
Retirar el material no implica que hayamos determinado que existe infracción: es el procedimiento que la ley nos exige seguir ante un aviso formalmente válido.
Si sos el anfitrión y considerás que tu material fue retirado por error o identificado equivocadamente, podés enviarnos una contra-notificación a copyright@guias-digitales.com que incluya, conforme al §512(g)(3):
(a) Tu firma física o electrónica.
(b) Identificación del material retirado y del lugar donde aparecía antes del retiro.
(c) Una declaración BAJO PENA DE PERJURIO de que tenés la creencia de buena fe de que el material fue retirado por error o como consecuencia de una identificación equivocada.
(d) Tu nombre, dirección y teléfono, junto con tu consentimiento a la jurisdicción del Tribunal Federal de Distrito correspondiente a tu domicilio o, si tu domicilio está fuera de Estados Unidos, del Distrito de Wyoming, donde LuckyGo Digital LLC tiene su domicilio; y tu aceptación de recibir la notificación judicial de quien envió el aviso original.
Reenviaremos la contra-notificación a quien presentó el aviso. Si en un plazo de diez (10) días hábiles no nos informa que inició una acción judicial para impedir la actividad, podremos restituir el material entre los diez (10) y catorce (14) días hábiles siguientes a la recepción de tu contra-notificación.
Damos de baja, en circunstancias apropiadas, las cuentas de los anfitriones que resulten infractores reincidentes. Esta política es un requisito del §512(i) y la aplicamos efectivamente.
El criterio general es escalonado: ante el primer aviso válido retiramos el material y advertimos al anfitrión; ante la reiteración suspendemos la cuenta; ante la reincidencia damos de baja la cuenta y las guías asociadas de forma definitiva. Nos reservamos la facultad de dar de baja una cuenta de inmediato ante una infracción flagrante o deliberada.
La baja por reincidencia no genera derecho a reembolso de los períodos ya facturados.
Conforme al §512(f), quien afirme a sabiendas y de forma sustancialmente falsa que un material infringe derechos —o que fue retirado por error— puede responder por los daños, incluidas las costas y los honorarios de abogados, en que incurran el presunto infractor, el titular de los derechos o nosotros.
No envíes un aviso si no sos el titular de los derechos ni estás autorizado a actuar en su nombre.

LuckyGo Digital LLC (trading as "Guías Digitales") operates a platform on which hosts publish guides containing their own content: text, photographs, videos and documents. That content is uploaded by the host, not by us.
We respect copyright and respond to infringement notices under the Digital Millennium Copyright Act (DMCA), 17 U.S.C. §512. If you believe material hosted on the platform infringes your rights, you may notify us using the procedure in section 3.

Send your written notice to copyright@guias-digitales.com. To be effective under §512(c)(3) it must include ALL of the following:
(a) A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
(b) Identification of the copyrighted work claimed to have been infringed.
(c) Identification of the material claimed to be infringing, with information reasonably sufficient to locate it: please give us the exact guide URL and the section where it appears.
(d) Your contact information: name, mailing address, telephone number and email address.
(e) A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
(f) A statement that the information in the notice is accurate and, UNDER PENALTY OF PERJURY, that you are authorized to act on behalf of the copyright owner.
An incomplete notice may not be legally effective. If an element is missing we will tell you.
We expeditiously remove or disable access to the material, notify the host who published it, provide them with a copy of the notice, and inform them of their right to submit a counter-notification.
Removal does not mean we have determined that infringement occurred: it is the procedure the law requires us to follow upon a formally valid notice.
If you are the host and believe your material was removed by mistake or misidentification, you may send a counter-notification to copyright@guias-digitales.com including, under §512(g)(3):
(a) Your physical or electronic signature.
(b) Identification of the material removed and the location at which it appeared before removal.
(c) A statement UNDER PENALTY OF PERJURY that you have a good faith belief the material was removed as a result of mistake or misidentification.
(d) Your name, address and telephone number, together with your consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located or, if your address is outside the United States, the District of Wyoming, where LuckyGo Digital LLC is located; and your acceptance of service of process from the person who submitted the original notice.
We will forward the counter-notification to the complaining party. If within ten (10) business days they do not notify us that they have filed an action seeking a court order to restrain the activity, we may restore the material between ten (10) and fourteen (14) business days after receiving your counter-notification.
We terminate, in appropriate circumstances, the accounts of hosts who are repeat infringers. This policy is required by §512(i) and we reasonably implement it.
Our general approach is graduated: on a first valid notice we remove the material and warn the host; on repetition we suspend the account; on further recurrence we permanently terminate the account and its associated guides. We reserve the right to terminate an account immediately in cases of flagrant or wilful infringement.
Termination for repeat infringement does not entitle the host to a refund of periods already billed.
Under §512(f), any person who knowingly materially misrepresents that material is infringing — or that it was removed by mistake — may be liable for damages, including costs and attorneys’ fees, incurred by the alleged infringer, the copyright owner, or us.
Do not send a notice if you are not the copyright owner or authorized to act on their behalf.
